CONDITIONS OF SALE
These conditions contain important terms which govern your business relationship with Dance Pro Clothing. Therefore please read them carefully and refer to this supplied copy for reference.
1.1 In these Conditions:
“Dance Pro” means DancePro Clothing:
“The Customer” means any person, undertaking, buying or offering to buy Goods from Dance Pro:
“Goods” means all products supplied by Dance Pro:
2.1 Orders are taken on receipt of an internet order invoice.
2.2 Ownership of the goods remains with Dance Pro until full payment is received from the customer for those said goods.
2.3 Once Dance Pro have received a customers order, this will be prepared.
3 Due to colour sensitivity in fabrics Dance Pro cannot guarantee Colour Fastness in any product.
4.1 Dance Pro may without prejudice suspend or cancel delivery of goods if the customer is in breach of its contractual obligations with regard to the payment terms.
4.2 Dance Pro will as far as possible will attempt to meet orders received and accepted. All orders are accepted conditionally upon the availability of the goods ordered, and Dance Pro shall not be liable for failure to meet any order or part thereof for any reason whatsoever.
4.3 Any dates quoted for delivery are approximate and Dance Pro shall not be liable for any delays in delivery howsoever caused.
4.4 The Risk in Goods will pass on Delivery. Carriers require that all claims be notified in writing within 7 days of the receipt of goods and non deliveries be notified within 14 days of the date of dispatch, for overseas deliveries 21 days. Claims notified after these periods will not be recognised.
4.5 Where so determined Dance Pro shall use an un-insured 2nd class Royal Mail Service, with Proof of Postage to the UK Mailnland Only. If the customer wishes an alternative service to their region then the customer should agree shipping costs with DancePro prior to purchase.
4.6 The customer will be solely responsible for any loss.
5.1 Dance Pro may from time to time have to adjust its catalogue prices without prior notification.
5.2 All prices include VAT where applicable and dispatch charges set out as above. VAT will be added where applicable to the total order including carriage & packing. VAT does not apply if the goods are being sent outside of the EC. Carriage costs are dependent on the size and weight of a bulk order, the destination and service used.
5.3 Dance Pro require goods to be paid for in full at the time of placing the order.
5.4 In the event that payment is not made Dance Pro have the right to withhold delivery of any goods.
5.4.1 In this instance Dance Pro will require pre-payment on all future orders.
6.1. All Goods may be returned for exchange if they are found to be faulty, within 5 days of receipt of the goods. If goods are returned because the wrong size has been ordered, postage will be charge for the return item.
6.2 Face mask’s/coverings, Underwear, Leotards or Dance Knicks cannot be exchanged.
6.3 Should Dance Pro deliver goods incorrectly then Dance Pro will reimburse the return postage cost at the equivalent of Royal Mail’s 2nd Class Standard Service at the prevailing rate. Dance Pro will re-deliver the replacement goods Post free. All returns must be authorised by Dance Pro via email before any goods are returned.
6.4 Goods are returned for exchange at the customer’s cost.
6.5 Goods must be returned without being worn or the tamper tag removed. Any returns with Wear Marks or without the tamper tag in tact will not be accepted for exchange or credit by Dance Pro.
6.6 Any claim based on a defect in quality or condition of goods supplied or failure to correspond with specifications must be notified to Dance Pro within 7 days of receipt of goods. In the event that the fault is accepted Dance Pro will replace the goods free of charge subject to availability.
6.7 It is advisable for “Proof of Posting” to be obtained.
6.8 General Return Conditions
In order for a return to be accepted, it must meet the following conditions:
6.8.1 The product must be unused and unworn.
6.8.2 The product must be in its original state and packaging.
6.8.3 Goods must have the original tags attached.
6.8.4 Accessories must have all parts of the original packaging.
6.9 Below products are excluded from returns:
6.9.1 Customised and personalised products, Underwear and Dance Knicks, Face Masks except in case of manufacturing defects,
6.9.3 sale Items will receive a credit note only.
7 Dealing with Goods
7.1 The customer shall not employ a third party to onward sell Dance Pro goods purporting to be an employee or agent of Dance Pro without the authorisation of Dance Pro.
8 Warranties & Liabilities
8.1 Dance Pro warrants that the goods sold will correspond with their description in the current Dance Pro catalogue.
8.2 Dance Pro shall be under no liability in respect to any defect arising from fair wear & tear, customer negligence, wilful damage, abnormal working conditions, failure to follow Dance Pro’s instructions (written or oral). Misuse or alteration/repair of the goods without Dance Pro’s approval.
8.3 Dance Pro shall be under no liability as to the quality of the goods beyond the occasion of their first use.
8.4 Dance Pro do not guarantee colours to be identical to that appearing in their catalogues or website. Slight colour variation may occur due to variations in dye lots.
8.5 Dance Pro do not guarantee their products to the fitness for the purpose intended by the customer. It is the customers’ responsibility to ensure that the goods are suitable for their own purpose.
8.6 The customer’s statutory rights are not affected by these terms & conditions.
9.1 All correspondence/notices shall be addressed to either parties registered office or principal address that we have on record at the time.
9.2 No waiver by Dance Pro of any breach of the contract by the customer shall be considered as a waiver of any subsequent breach of the same or any other provision.
9.3 This contract shall be enforceable by the laws of England and will be settled as such in the courts of England.
ACKNOWLEDGEMENT by receiving these terms & conditions it is implied that the customer agrees and abides by them.
10 Method of Payment
10.2 Credit Card/Debit Cards. (which may incur a 3% charge in some cases)
10.4 Bank transfer
11 No other foreign currencies are accepted. This is due to the high handling charges levied by our bank.
12. Festive and Holiday period Deliveries
12.1 We do not accept responsibility for late delivery during these times anywhere in the world.
12.2 Due to the ongoing Pandemic, International Shipping may be suspended with Royal Mail. Please check if your destination is currently suspended on their website; https://personal.help.royalmail.com/app/answers/detail/a_id/5317
12.3 Please contact us should you wish an express service or another carrier for charges prior to ordering your items.
